PILE ELBUD S.A. with its registered office in Kraków, Ciepłownicza 20 (31-574 Kraków), KRS (National Court Register): 0000515479, NIP (Taxpayer Identification Number): 6792628182, REGON (National Business Register): 357146655 (hereinafter referred to as “PILE ELBUD” or “Controller”), as the controller of personal data, processes personal data of individuals of the following categories:

  1. individuals contacting PILE ELBUD (by phone, e-mail or letter) and individuals whom PILE ELBUD contacts in the aforementioned manners;
  2. PILE ELBUD’s customers;
  3. PILE ELBUD’s contractors and their employees and associates
  4. job candidates or individuals applying for the conclusion of civil law contracts.

PILE ELBUD processes your personal data in order to contact you in response to your application or inquiry.

The legal basis for the processing of your data is the legitimate interest of PILE ELBUD (Art. 6 (1) (f) of the GDPR) consisting in the possibility of providing an answer to your question regarding the company’s activities or the settlement of a matter initiated by you.

PILE ELBUD processes your data including in particular: name and surname, telephone number, and e-mail address. PILE ELBUD receives the aforementioned data directly from you.

Your personal data is provided to entities to which PILE ELBUD has commissioned services related to the processing of personal data, e.g. IT services.

In addition, your personal data may be provided to PILE ELBUD’s contractors if it is justified in order to answer your question or to settle a matter initiated by you.

Your data will be stored for the time necessary to handle your inquiry or settle the matter initiated by you and for the period of limitation of any claims.

Providing your data is voluntary, but necessary for us to be able to contact you in response to your application or inquiry. Your personal data will not be subject to automated decision making, including profiling.


5. Data Subject Rights

In connection with the processing of personal data by PILE ELBUD, you have the following rights:

      1. the right to object;
      2. the right to access your data;
      3. the right to correct your data;
      4. the right to delete your data;
      5. the right to limit the processing of your data;
      6. the right to transfer your data.

In addition, you have the right to lodge a complaint with the supervisory body, which is the President of the Polish Personal Data Protection Office, in the event that the processing of your data violates the provisions on the protection of personal data.

The legal basis for the processing of your data is the legitimate interest of PILE ELBUD consisting in the possibility of ongoing contact with the company’s contractors and the performance of concluded contracts (Art. 6 (1) (f) of the GDPR).

4. Data Recipients and Storage Period

Your personal data is provided to entities to which PILE ELBUD has commissioned services related to the processing of personal data, e.g. IT services.

Personal data is processed for the duration of the contract between PILE ELBUD and its contractor and for the period of limitation of any claims arising therefrom.

Providing your data is a condition for the performance of the contract between PILE ELBUD and the contractor you represent.

Your personal data will not be subject to automated decision making, including profiling.

In connection with the processing of personal data by PILE ELBUD, you have the following rights:

2. Basis and Purposes of Personal Data Processing

The Controller processes your personal data on the basis of the following legal basis:

      1. In the case of employment contracts:
        1. Provision of law (Art. 221 § 1 of the Labour Code) (Art. 6 (1) (c) of the GDPR) and processing being necessary in order to conclude the employment contract (Art. 6 (1) (b) of the GDPR) - in the scope of the following data: name and surname, parents’ names, date of birth, place of residence (correspondence address), education, history of employment.
        2. Your consent to the processing of your data provided in your CV and cover letter (Art. 6 (1) (a) of the GDPR) if you provide data other than: name and surname, parents’ names, date of birth, place of residence (correspondence address), education, history of employment.
        3. The legitimate interest of PILE ELBUD (Art. 6 (1) (f) of the GDPR) - in the scope of data collected during the interview and the results of qualification tests, PILE ELBUD S.A. has a legitimate interest in verifying your skills and qualifications.
        4. Consent to the processing of your personal data for the purposes of future recruitment (Art. 6 (1) (a) of the GDPR).
      2. In the case of civil law contracts:
        1. Your consent to the processing of your data (Art. 6 (1) (a) of the GDPR) and processing being necessary in order to conclude the contract (Art. 6 (1) (b) of the GDPR) - in the scope of the following data: name and surname, parents’ names, date of birth, place of residence (correspondence address), education, history of employment, and possibly other data provided in particular in your CV and cover letter.
        2. The legitimate interest of PILE ELBUD (Art. 6 (1) (f) of the GDPR) - in the scope of data collected during the interview and the results of qualification tests, PILE ELBUD has a legitimate interest in verifying your skills and
        3. Consent to the processing of your personal data for the purposes of future contracting procedures (Art. 6 (1) (a) of the GDPR).

The Controller processes your personal data in order to:

        1. assess your qualifications to work or perform specific activities on the basis of civil law contracts;
        2. assess your abilities and skills needed to work or perform specific activities on the basis of civil law contracts;
        3. choose the right person to work at PILE ELBUD S.A. or perform specific activities on the basis of civil law contracts.

Providing the data contained in the application documents is not obligatory, however, it is a condition for you to be able to apply for employment at PILE ELBUD S.A. or for the company to conclude a specific civil law contract with you.


3. Data Recipients and Storage Period

We will process your data until the end of the recruitment process for the position which you are applying for or until the end of the process aimed at concluding a specific civil law contract.

If you consent to the processing of personal data for the purposes of future recruitment or procedures aimed at concluding a specific civil law contract, your data will be processed for a period of 1 year from the moment it is collected.

Your personal data is provided to entities to which PILE ELBUD has commissioned services related to the processing of personal data, e.g. IT services.


4. Data Subject Rights

You have the following rights:

      1. the right to object;
      2. the right to access your data;
      3. the right to correct your data;
      4. the right to delete your data;
      5. the right to limit the processing of your data;
      6. the right to transfer your data.

To the extent that your data is processed on the basis of your consent, you have the right to withdraw such consent to the processing of your data at any time.

Withdrawal of consent does not affect the lawfulness of the processing which was carried out on the basis of your consent before its withdrawal.

You may withdraw your consent by sending a consent withdrawal declaration to the PILE ELBUD’s correspondence address or to the e-mail address indicated in Section 1.

In addition, you have the right to lodge a complaint with the supervisory body, which is the President of the Polish Personal Data Protection Office, in the event that the processing of your data violates the provisions on the protection of personal data.
